All Bar None! Pt II

After having been refused a Liquor Licence for its proposed Cambridge Circus venue, All Bar One (BASS) lodged an appeal in the Crown Court against the decision of the Licensing Justices.
The appeal hearing was originally scheduled to take place on Thursday 17th and Friday 18th December. Once we were informed that All Bar One would be represented by John Saunders QC, we decided to ask for the appeal to be adjourned to enable the Association to instruct a barrister too.
Whilst the CGCA normally makes its own representations in the local Magistrates Courts and at meetings of the Licensing Sub-committees at Camden and Westminster Councils, we realised that this appeal case was too important to lose and that we needed to have proper representation to be able to defend our case properly.
When All Bar One refused to agree to an adjournment, the Court decided that our request should be determined by a Judge. On Tue 8th December His Honour Judge Fabyan Evans decided that the CGCA should try to find legal representation and appear before him again the following week if it had been unsuccessful.
On Mon 14th December the CGCA, by then having found a solicitor and a barrister, repeated its request for an adjournment, as our barrister was unable to meet with all objectors and study the case at such short notice. The Judge was told by All Bar One's barrister that BASS stood to lose a lot of money if its lease agreement expired and that it would be very inconvenient to get its 10+ witnesses to attend at a different date.
Judge Evans, after having heard the CGCA's plea that it would be without legal representation if the appeal were to proceed on 17/12 and 18/12, decided to grant the CGCA's request for an adjournment "so that Justice may be seen to be done".
The new date for the appeal has not yet been set but is likely to be during the last week of January 1999. The appeal will be heard at the Crown Court, Middlesex Guild Hall, Parliament Square, London SW1. Please show your support for the CGCA by attending the hearing – anyone (sorry, no children allowed in Court) is free to come and hear part or all of the proceedings. Just turn up at 10:30am at the Reception Desk in the Court.
